About Pat
Pat Pericak specializes in providing expert consulting advice to law firms and public and private companies in complex investigations involving allegations of fraud, foreign bribery (FCPA), and money laundering violations, as well as violations of securities and commodities laws and regulations. Mr. Pericak also provides forensic accounting and data analytics support to monitors, particularly those appointed in FCPA-related matters. Additionally, he assists companies in developing and strengthening compliance programs, including by helping develop and improve their policies, procedures and internal controls, as well as conducting third-party audits.
Mr. Pericak has more than 20 years of experience working on these types of matters. He provides industry-leading consulting advice, and was recognized as one of the Top 30 FCPA Practitioners in Global Investigations Review’s June 2021 inaugural list, which was based on interviews with industry insiders, including practice heads, in-house lawyers, and former government officials to find out who they thought the best practitioners were that they’ve worked with in the United States on foreign bribery matters.
Prior to joining FTI Consulting in September 2016, Mr. Pericak was a federal prosecutor with the U.S. Department of Justice for more than a decade, most recently serving in the FCPA and Securities and Financial Fraud Units of the Criminal Division's Fraud Section. Previously, he worked in the Department of Justice Tax Division, where he prosecuted criminal violations of the tax laws, as well as False Claims Act violations, and at the U.S. Attorney's Office for the District of Maryland, where he prosecuted cases involving, among other things, money laundering and Medicare/Medicaid fraud. Mr. Pericak also spent three years working as a Senior Associate and later a Special Counsel at Cadwalader, Wickersham & Taft, LLP, where he conducted internal investigations for boards of public and private companies, and represented individuals in such matters. The matters involved, among other things, allegations of violations of the FCPA, the False Claims Act, and the securities and other financial fraud laws. In addition, Mr. Pericak worked for three years as an enforcement attorney at the U.S. Commodity Futures Trading Commission, where he investigated and brought enforcement actions in fraud, market manipulation, and trading regulations matters.
Since joining FTI in September 2016, Mr. Pericak has led a variety of matters, including: support to two FCPA monitors; forensic accounting and data analytics support to law firms in connection with FCPA investigations in Latin America, Asia, the Middle East, Asia, and Africa; anti-corruption compliance program and risk assessments for companies in the technology, food processing, and finance industries; forensic support in a criminal investigation into certifications provided to the EPA; assistance to multiple investment fund managers in ensuring management fees and profits and losses were calculated and allocated properly; pre-acquisition anti-corruption due diligence in connection with a consulting firm’s acquisition of a telecommunications consulting group; post-acquisition anti-corruption due diligence for a technology company’s acquisition of a software provider; and e-discovery services in a multitude of internal investigations, including investigations involving subpoenas and requests from the U.S. Department of Justice.
