About Daryl

Daryl Teshima is a Senior Managing Director in FTI Consulting’s Technology practice and is based in Los Angeles. Mr. Teshima assists clients with the electronic data discovery process in litigation and government investigations, and in developing in-house corporate e-discovery and records management programs. He has more than 15 years of experience in information management and litigation support.

Mr. Teshima has wide experience in the issues presented by electronic discovery, including data acquisitions and examinations, analysis and conversion of structured and unstructured data, and review and production of electronic documents, databases and web sites. He also advises on information management, helping agencies and companies update their approach to records management in the electronic age. His responsibilities span from managing examinations and investigations of computer data to the daily management of electronic discovery consulting staff.

Prior to joining FTI Consulting, Mr. Teshima managed Operations for KPMG’s Forensic Technology service, which encompassed the implementation of SOC-2 Type-A certified electronic data procedures and the establishment of globally consistent methodologies that included implementing kCura Relativity in more than 15 geographies and establishing a follow-the-sun support plan. Mr. Teshima was also a principal of Strategic Discovery, Inc., which was acquired by FTI Consulting in 2008 and which he co-founded in 2002. In addition, Mr. Teshima was Director of Practice Systems for Gibson, Dunn & Crutcher LLP, where he guided the Firm’s application of technology to the practice of law.

Relevant Experience:

  • Managed the electronic data acquisitions, analysis, review and production for over 35 antitrust second requests and investigations, including the following matters while at FTI Consulting:
    • Federal Trade Commission second request and trial resulting from the merger of two insurance software companies.
    • Compliance with Department of Justice civil investigation document demands stemming from proposed Internet advertising partnership agreement.
    • Department of Justice second request resulting from the merger of two technology companies and requiring collections in Australia and Europe.
    • Department of Justice second request involving two technology companies and requiring the processing and handling of non-Microsoft Office email and data formats.
  • Coordinated the preservation, data acquisition, conversion, and electronic productions of over a terabyte of information in SEC investigation of mortgage securities company.
  • Bray & Gillespie Management, LLC. v. Lexington Insurance Company Dkt. No.6:07-cv-222-Orl-35KRS (US District Court, Middle District of Florida) June/December 2008. Provided courtroom testimony for insurance company challenging the sufficiency of plaintiffs’ electronic data production. Resulted in reported decision (Bray & Gillespie Mgmt. LLC v. Lexington Ins. Co., 2009 WL 546429 (M.D. Fla. Mar. 4, 2009) and sanctions being awarded against plaintiffs.
  • Led investigation and remediation of trade secret documents brought by new hire from former employee and stored on new employer’s network and email system.
  • TSMC North America v. Semiconductor Manufacturing International Corporation, et al., Case No.RG-06-286111 (Superior Court of the State of California, County of Alameda) August 2009. Provided expert testimony and opinion analyzing the sufficiency of remediation efforts as well as electronic discovery minimum standards.
  • Provided records and information management compliance consulting to agencies and companies, helping update their approach to records retention in the electronic age. In 2008, these projects included:
    • Development of retention schedules applicable to electronic data,
    • Audit and gap analysis of company’s current electronic data practices,
    • Evaluation and analysis of content management software solutions, and
    • Design of litigation hold notice management system.
  • Counseled, managed and handled electronic discovery work for high-profile Internet search company. Scope of work includes the development of a production repository, management of outside counsel, and directly handling over 100 litigations and investigations.
  • Managed the identification, processing and review of Asian-based email and documents in FCPA investigation.
  • Led and coordinated the expedited collection, review and production to overturn the issuance of a preliminary injunction filed by shareholders to block the merger of two enterprise software companies. This project involved the review of over 250,000 electronic documents in five days by three bi-coastal legal teams.

Publications and Speaking Engagements

Mr. Teshima has also served as Editor-in-Chief of Law Office Computing, an award-winning technology magazine. In addition, he has served as the Editor-in-Chief of other technology and legal publications, including the California State Bar’s Law Practice Management and Technology newsletter. He is also a recognized speaker and author on legal technology issues, with over 50 published articles and presentations.
